Illinois Biometric Information Policy

Current product posture: HyperPulse does not intentionally collect biometric identifiers such as fingerprints, voiceprints, retina scans, iris scans, facial recognition templates, or face geometry scans. This policy exists because Illinois law treats biometric information carefully and athlete movement data can be sensitive.

1. Scope

This policy applies to HyperPulse users in Illinois and to any HyperPulse feature that may collect or process biometric information or biometric identifiers as those terms are defined by applicable Illinois law.

2. What HyperPulse May Collect

HyperPulse may collect motion and device data from a wearable athletic sensor, including acceleration, angular velocity, timestamps, device identifiers, firmware status, and derived training-context metrics. These outputs are used for athletic performance context only.

HyperPulse does not intentionally collect fingerprints, voiceprints, retina or iris scans, facial recognition templates, face geometry scans, or hand geometry scans.

3. Purpose

HyperPulse uses collected motion and performance data to operate the app and device, display parent-managed athlete performance information, provide support, maintain security, improve product reliability, and comply with legal obligations.

4. Consent

If a HyperPulse feature requires collection or use of biometric information covered by Illinois law, HyperPulse will request written consent before collection or use. For a minor athlete, consent must be provided by a parent or legal guardian with authority to consent.

Users may decline consent. Some features may be unavailable without required consent.

5. Disclosure and Sale

HyperPulse does not sell, lease, trade, or otherwise profit from biometric identifiers or biometric information. HyperPulse discloses information only as permitted by law, with consent, to service providers needed to operate HyperPulse, or where required by valid legal process.

6. Retention and Deletion

HyperPulse retains biometric information, if any is collected, only as long as needed for the purpose collected or as otherwise required by law. Unless a longer retention period is legally required, HyperPulse will delete covered biometric information when the initial purpose has been satisfied or within three years of the user's last interaction with HyperPulse, whichever occurs first.

To request deletion, email privacy@gethyperpulse.com. Parent or guardian requests for minor athlete data should include enough information for us to verify authority and locate the relevant account.

7. Security

HyperPulse uses reasonable safeguards for stored data, including access controls, encrypted transport, and service-provider restrictions. No system is perfectly secure, and users should not treat HyperPulse as a medical, safety, emergency, or injury-monitoring system.
